ACC Graduation Social Media Contest Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN
The “Graduation Social Media Contest” (“Contest”) is sponsored by American Career College (ACC) (“Sponsor”). The Contest is governed by these official rules (“Official Rules”). By participating in the Contest, each entrant agrees to abide by these Official Rules, including all eligibility requirements, and understands that the results of the Contest, as determined by Sponsor and its agents, are final in all respects. The Contest is subject to all federal, state and local laws and regulations and is void where prohibited by law.

ELIGIBILITY
The Contest is open to legal residents of the United States of America who are eighteen (18) years of age or older at the time of entry. Each entrant must be an ACC Graduate who is scheduled to participate in the May 4th, 2019 graduation ceremony. New students are not eligible to participate in their first week of school. Sponsor has the right to verify the eligibility of each entrant and to disqualify a post if it is deemed to be inappropriate (i.e. inappropriate use of school property, language, content, etc.).

CONTEST PERIOD
The Contest begins on April 24th, 2019 at 8am PST and ends on April 30th, 2019 at 11:59pm PST. (“Contest Period”). All entries (submissions) must be received during the Contest Period. Sponsor reserves the right to extend or shorten the Contest Period at its sole discretion.

HOW TO ENTER
You can enter the Contest by 1) posting a photo on Facebook or Instagram at an ACC Campus, 2) Caption the photo with what you love the most about ACC, 3) Follow ACC on Instagram and Facebook and have a public profile 4) Use the hashtags: #iloveACC #americancareercollege #entry.

WINNER SELECTION
All eligible entries received during the Submission Period will be gathered shortly after the Submission Period. A winner will be chosen at random.
Announcement and instructions for contest winner would be sent to the user via Instagram Direct Message. If a potential contest winner cannot be reached within fifteen (15) days that potential contest winner shall forfeit the prize. Upon the request of the Sponsor, the potential winner may be required to return an Affidavit of Eligibility, Release and Prize Acceptance Form and IRS W-9 form. If a potential winner fails to comply with these official rules, that potential winner will be disqualified.

PRIZE(S)
Grand Prize is a $1500 Gift Card + 6 VIP graduation tickets (1 winner).  6 winners will receive 5 VIP Graduation tickets.
Incidental expenses and all other costs and expenses which are not specifically listed as part of a prize in these Official Rules and which may be associated with the award, acceptance, receipt and use of all or any portion of the awarded prize are solely the responsibility of the respective prize winner. ALL FEDERAL, STATE AND LOCAL TAXES ASSOCIATED WITH THE RECEIPT OR USE OF ANY PRIZE IS SOLELY THE RESPONSIBILITY OF THE

WINNER
Odds of winning will depend on the number of entries. Information collected from each entrant is subject to Sponsor’s Privacy Policy

WINNER LIST REQUESTS
Any legally required list of winners may be obtained by sending an e-mail with the subject line: “ACC Graduation Social Media Contest Winner List Request" to JVartanian@americancareercollege.edu. All such requests must be received within six (6) weeks after the end date of the Contest.

ADDITIONAL LIMITATIONS
Prize is non-transferable. No substitution or cash equivalent of prizes is permitted. Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives are not responsible   for any typographical or other errors in the offer or administration of the Contest, including, but not limited to, errors in any printing or posting or these Official Rules, the selection and announcement of any winner, or the distribution of any prize. Any attempt to damage the content or operation of this Contest is unlawful and subject to possible legal action by Sponsor. Sponsor reserves the right to terminate, suspend or amend the Contest, without notice, and for any reason, including, without limitation, if Sponsor determines that the Contest cannot be conducted as planned or should a virus, bug, tampering or unauthorized intervention, technical failure or other cause beyond Sponsor’s control corrupt the administration, security, fairness, integrity or proper play of the Contest. In the event any tampering or unauthorized intervention may have occurred, Sponsor reserves the right to void suspect entries at issue. Sponsor and its respective parent, affiliate and subsidiary companies, agents, and representatives, and any telephone network or service providers, are not responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunction, lost or delayed data transmission, omission, interruption, deletion, line failure or malfunction of any telephone network, computer equipment or software, the inability to access any website or online service or any other error, human or otherwise.

RELEASE
By participating, each entrant agrees to release, hold Sponsor and the employees, officers, directors, shareholders, agents, and representatives of Sponsor, its affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors harmless from and waive any and all losses, damages, rights, claims, and actions of any kind in connection with the Contest or resulting from entrant's participation, acceptance, possession, or use of any prize, including, without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy.

LIMITATION OF LIABILITY
Sponsor, its agents and representatives, its affiliates, subsidiaries, advertising, promotion, and fulfillment agencies, and legal advisors are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible or unintelligible entries; (ii) any condition caused by events beyond the control of Sponsor that may cause the Contest to be disrupted or corrupted;
(iii) any printing, programming or typographical errors in any materials associated with the Contest or technical, computer, network or human error which may occur in the administration of the Contest or the announcement of the winner; (iv) unauthorized human intervention in any part of the Contest process; (v) any unauthorized third party use of any entry information; or (vi) any injuries, losses, or damages of any kind arising in connection with or as a result of the prize, or acceptance, possession, or use of the prize, or from participation in the Contest.

DISPUTES
All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules or the rights and obligations of entrant and Sponsor in connection with the Contest shall be governed by and construed in accordance with the laws of the State of California, without giving effect to any choice of law rules or provisions (whether of the State of California or any other  jurisdiction) that would cause the application of the laws of any other jurisdiction other than the State of

PUBLICITY
By participating, each entrant grants Sponsor the worldwide and perpetual right and authority to use, reproduce, distribute, broadcast or otherwise transmit, publish and display his/her name, submission, likeness or comments for publicity purposes without payment of additional consideration, except where prohibited by law.
